Polish-Palestinian survivors of Gaza war file complaint against Israeli leaders over genocide

A complaint has been filed in a court in southern Poland by two Palestinian-Polish survivors of the Israeli aggression in Gaza against the leaders of the Israeli regime for committing genocide, war crimes, and crimes against humanity.

The Middle East Eye (MEE) said in a Tuesday report that the complaint, filed by Amjad Agha and Ahmed Elsaftawy in a court in Wrocław in southern Poland, would be one of the first of its kind in Europe that tests whether prosecutors would seriously treat international crimes against their own nationals.

The complaint was filed against the former Israeli minister for military affairs, Yoav Gallant, and his successor, Israel Katz; the former and current chiefs of staff of the Israeli military; the commander of the Israeli navy; the minister of energy and water; and the current and former heads of the Coordination of Government Activities in the Territories, the body that controls humanitarian access to Gaza and the occupied West Bank.

The two complainants have been to Gaza during the Israeli genocidal war that began in October 2023 and have Polish citizenship because of their educational background in the European country.

The two have lost dozens of members of their extended families, while their wives and children have experienced traumatic scenes of Israeli attacks on their homes in Gaza.

Elsaftawy told MEE that he expects the Polish legal system to respect his rights not as a citizen but as a human being.

"Poland has a duty to adhere to the principles of international law, the protection of human rights and responsibility for the safety of its citizens… I am demanding only the right to the truth, accountability and the protection of fundamental humanitarian values, which should apply regardless of nationality, religion or origin," he said.

The Israeli war of aggression on Gaza came to a relative respite in October last year when a ceasefire was announced by the United States and regional mediators.

However, the regime has continued to constantly violate the ceasefire, killing hundreds of people, in addition to the over 76,000 it massacred during the genocidal war, while exacerbating the humanitarian situation in the territory by blocking most of the international aid seeking to reach the Palestinians.
